Security

 

We take steps to protect against the loss, misuse, or unauthorized alteration of personally-identifiable information collected through this Web site. We recognize the importance of security for all personally-identifiable information collected by our Web site. We exercise care in providing secure transmission of your information from your computer to our servers.

Once we receive personally-identifiable as part of the reservation process, we take steps to protect its security on our systems. In the event we request or transmit sensitive information, such as credit card information, we use industry standard, secure socket layer (“SSL”) encryption.

 
Waiver

 

After booking, we will provide you with a waiver form to be read and signed by each Passenger. You will not be allowed onboard our vessels without a signed waiver. 

WILDLIFE DISCLAIMER

Please note that to the unpredictable nature of wildlife, we are not in a position to guarantee any wildlife sightings. Neither can be a basis for any refunds. Be assured, we’ll do our best to improve our chances of success.There's always something wonderful to discover at sea. Patience is a well-rewarded virtue at the open ocean.

Departure Time

We urge all our guests to plan ahead to be sure they arrive on time, preferably 20 minutes prior to the tour departure time. This is because we might have two tours a day that run back-to-back, and we need to start our tours on time. Additionally, we need five to ten minutes to give you a safety briefing. 

 

If you arrive an hour late therefore, you will still be able to go on your tour, however you will lose an hour of your scheduled time.

MINIMUM THRESHOLD

We need a minimum of three guests for our public charters to run.  

If we don't reach the minimum threshold on your Pelagic Offshore or Blue Shark expedition we'll let you know and you'll be presented with the following options:

 

A) Purchase an additional ticket. (To reach the minimum threshold)

B) Reschedule to another open date or stay on a 'holding pattern' until we find another guest at a later date.                       

C) Ask for a full refund.               

Trip Duration Adjustments

Expedition duration may be shortened at the explicit request of passengers, or if deemed necessary by the Captain for safety or comfort. No partial refunds shall be provided where guests voluntarily request an early return or otherwise shorten the trip.

Motion Sickness and Personal Conditions

Seasickness or any other personal medical condition is the sole responsibility of the guest. Preventive measures are advised and recommended on our website and during orientation. Refunds or rescheduling are not available due to seasickness or related conditions once an expedition has departed.

Fair Conduct

Guests agree to provide feedback in good faith. Attempts to obtain refunds through threats of negative reviews, chargebacks, or misrepresentation of events shall be considered fraudulent behavior. Net Zero Expeditions reserves the right to pursue recovery of losses and costs in such cases.

Force Majeure / Weather Confirmation

Expedition conditions (swell, wind, weather) are subject to natural variability. Operations will proceed when conditions are within U.S. Coast Guard defined safe operating limits. Guest perceptions of comfort shall not be a basis for refunds where operations are conducted safely.

Tips

Gratuities are never expected. However, it's standard etiquette to give 15% or 20% from the ticket price to our hardworking crew.

Of course, if you are satisfied with the service. This can be paid in cash or via VENMO on completion of your trip .

 

Damage to Vessels

 

The customer accepts and recognizes that they are responsible for proper use of vessel and ensuring that it remain in a good state, and agree to cover the cost of any damage caused to the vessel, its accessories or finishes, derived from negligence, misuse or misconduct of any passenger during the trip.

Wildlife and Satisfaction Policy

At Net Zero Expeditions, our priority is guest safety and respectful interaction with marine wildlife. All expeditions are conducted in the open ocean with wild animals whose behavior is unpredictable and outside of our control.

While every effort is made to provide opportunities to observe or swim with sharks, sightings and in-water interactions are not guaranteed. Factors such as weather, ocean conditions, or shark behavior (including overly aggressive behavior that may limit safe swimming) may affect the experience.

For this reason, refunds will not be issued on the basis of guest satisfaction, lack of sightings, or inability to enter the water due to safety conditions. The charter fee covers the operational costs of the vessel, crew, and expedition, which are fully delivered regardless of wildlife activity.Photo and Video Packages
 

Photography and media Package


The Photography Package fee of $250 is considered earned in full upon booking and is non-refundable. The photographer will make best efforts to capture images and/or video of the individual(s) or group who purchased the package. However, due to variable environmental and wildlife conditions, it may not always be possible to obtain specific images of participants. In such cases, Net Zero Expeditions will provide all available photos and/or video captured during the expedition.

Optional photo and video packages are separate add-on services. Refunds for these packages will only be issued if no usable media is captured and provided. The definition of “usable media” is at the sole discretion of Net Zero Expeditions and may include photos or video of wildlife, vessel activities, or guest interactions, depending on the conditions of the day.

As the photographer is contracted on a per-day basis, refunds will not be granted on the grounds of unavailable or limited footage. All photos and videos delivered are licensed to the purchaser for personal, non-commercial use only. Any commercial use, reproduction, or distribution requires prior written consent from Net Zero Expeditions.

 

Accidental damage, death and injury

 

Any water activity implies risks. In case of injury or death in water and on boats. Net Zero Expeditions will be held harmless from any and all claims or liability for property damage, personal injury or death arising from or related to, directly or indirectly, the usage of the boat, water accessories and activities related to the expedition.

 

Prohibitions

 

Any violation of these points is grounds for cancellation of the trip without the right to any type of refund:

 

  • The consumption of illegal drugs or Alcohol is prohibited aboard our vessels.

  • Marijuana is strictly prohibited aboard our vessels.

  • It is prohibited to throw any type of food or object into the sea.

  • It is prohibited to stand anywhere other than on the floor of the boat.

  • It is prohibited to jump into the water without prior authorization from the crew.

  • It is prohibited to separate from the group while snorkeling if not previously authorized.

  • Swimming below the boat is prohibited.

  • It's forbidden to touch or harass any marine life. 

  • It is forbidden to touch any navigation device of the ship or any of its controls.

  • It is forbidden to bring Alcoholic drinks, recreational or illegal drugs onboard the vessels. 

GIFT CARDS

Gift cards are fully guaranteed and have a validity of 365 days from it's emission. 

 

Price Guarantee

The price of your private or public charter is fully guaranteed and will not be subject to any additional surcharges. Whilst we reserve the right to increase or decrease our prices at any time, once you have booked your charter and paid in full, the price shown on your invoice is fully guaranteed.

VENUE

The venue of any dispute that may arise out of this agreement or otherwise between the parties in which Net Zero Expeditions or its agents is a party shall be in a court in San Diego, county of San Diego, state of California.
